# Can Foreigners Buy a Condo in Thailand? The 49% Quota Explained

Yes. Under the Condominium Act B.E. 2522 (1979), foreigners can buy a condo unit in Thailand and hold the title in their own name, but foreign-owned units together may not exceed 49% of the total unit area of the building, and the money must be brought in from abroad in foreign currency, with a bank document to show at the transfer. 336 of the 340 condos for sale on DooAsset are freehold.

## What foreigners can and cannot own

| Type | Can a foreigner hold the title? |
|---|---|
| A unit in a condominium | Yes, within the building's foreign quota |
| Land (houses, townhouses) | Generally no, under the Land Code |
| Long lease | Yes; a lease can be registered for up to 30 years at a time |

That is why a condo is the main way for foreigners to own a home in Thailand.

## The 49% foreign quota

- The Condominium Act limits the units owned by foreigners to **49% of the total unit area** of the building.
- Before you reserve, ask the seller or the condominium juristic person to **confirm that foreign quota remains**. The Land Office checks the ratio on transfer day.
- If the quota is full, a foreigner cannot take that unit in their own name.

## Bringing the money in

- The purchase money must be **transferred from abroad in foreign currency** and converted to baht by a bank in Thailand.
- The receiving bank issues a document confirming the transaction, such as a Foreign Exchange Transaction Form (FET) for amounts of USD 50,000 or more, or a bank letter for smaller amounts.
- State in the transfer details that it is for buying a condominium unit, with the building name and unit number, and keep every document for the Land Office.

## Freehold or leasehold

As of 4 Oct 2026 DooAsset lists 340 condos for sale: 336 freehold, 2 leasehold and 2 not stated. A freehold buyer receives the condominium title deed in their own name.
